A lawsuit was recently filed against China’s leading smartphone maker, Xiaomi, by a U.S. based patent watchdog, Blue Spike LLC, in a court in Texas, NetEase news reported on Monday.

Blue Spike claims Xiaomi has infringed the U.S. “Data Protection Method and Device” patent and used the patent in dozens of products including the Mi 4 series, Mi Note Plus and even the unannounced Xiaomi Mi 5 and Mi 5 plus.

Xiaomi has yet to move into the U.S. market. The handsets in question are sold on Tomtop, an e-commerce firm based in Shenzhen.

This is not the first time that Xiaomi is being sued for patent violation in an overseas market. Ericsson filed a lawsuit against Xiaomi in February in New Delhi, India.
